Account Creation

• You may create an account using email, Apple Sign-In, or as a guest (anonymous)
• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use

Account Security

• Use a strong password
• Do not share your account credentials
• We are not liable for losses due to unauthorized access

Account Deletion

You may delete your account at any time through App settings. Account deletion is permanent and cannot be undone.

Upon deletion:

• All your data (profile, steps, friends, clubs) will be deleted
• You will be removed from all clubs
• Any active subscriptions will be cancelled
• You will lose access to Pro features immediately

Health Data

• The App accesses step count data from Apple HealthKit with your permission
• You control HealthKit access through iOS Settings
• We do not provide medical advice, diagnosis, or treatment
• Step count data is for informational and social purposes only

Medical Disclaimer

THE APP IS NOT INTENDED FOR MEDICAL USE. The App and its content are not medical advice. Consult a healthcare provider before starting or changing any fitness program, especially if you have health conditions.

We are not responsible for:

• Injuries or health issues from using the App
• Accuracy of step count data
• Decisions made based on App data
• Medical emergencies

Use the App at your own risk.

Subscription Plans

• Basic: Free tier with limited features
• Authenticated: Free tier for registered users
• Pro: Paid subscription with enhanced features (monthly, annual, or lifetime)

Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You will be charged through your Apple App Store account
• Renewal charges occur within 24 hours of the end of the current period
• You can manage or cancel subscriptions in App Store settings

Pricing and Changes

• We may change subscription prices with notice
• Price changes apply to subsequent subscription periods
• Current subscribers are notified of price increases

Payment Processing

• Payments are processed by Apple through the App Store
• We use RevenueCat for subscription management
• We do not store your payment card information
• Apple's payment terms apply to all transactions

Refunds

• Refund requests are handled by Apple according to App Store policies
• We do not provide refunds except as required by law
• For subscription issues, contact Apple Support or us

Subscription Cancellation

• Cancel anytime through App Store settings
• Cancellation takes effect at the end of the current billing period
• You retain access to Pro features until the period ends
• No refunds for unused portions of the current period (except as required by law)

Lifetime Subscriptions

• Lifetime subscriptions provide Pro access for the lifetime of the App
• "Lifetime" means the operational lifetime of the App, not your lifetime
• If we discontinue the App, lifetime subscriptions may terminate without refund

User-Generated Content

You may create, upload, or share content including:

• Profile information (name, username, profile picture)
• Club names, descriptions, and settings
• Activity logs and status updates

Your Responsibilities

You agree not to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Post false, misleading, or fraudulent information
• Harass, abuse, threaten, or harm others
• Post offensive, obscene, or inappropriate content
• Impersonate others or misrepresent your identity
• Spam, phish, or engage in fraudulent activity
• Interfere with or disrupt the App
• Attempt to gain unauthorized access
• Use automated systems to access the App
• Reverse engineer or decompile the App
• Remove copyright or proprietary notices

Content Moderation

We reserve the right to:

• Monitor, review, and moderate user content
• Remove or disable content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Report illegal activity to law enforcement

We are not obligated to monitor content but may do so.

Content License

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute your content to operate and promote the App.

Our Rights

• The App, including design, text, graphics, logos, and software, is owned by us or our licensors
• All rights are reserved
• "Steps Club" and related marks are our trademarks

Your Rights

• You retain ownership of your user-generated content
• You grant us the license described in Section 7

Restrictions

You may not:

• Copy, modify, or create derivative works
• Reverse engineer or attempt to extract source code
• Remove copyright or proprietary notices
• Use our trademarks without permission

By You

• You may stop using the App at any time
• Delete your account through App settings
• Cancel subscriptions through App Store settings

By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the App or other users
• Fail to pay subscription fees
• Otherwise violate these Terms

Effect of Termination

• Your right to use the App immediately ceases
• We may delete your account and data
• Provisions that should survive will survive

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Step count data is accurate or complete

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from unauthorized access or data breaches
• Damages resulting from third-party services

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusions or limitations, so some of the above may not apply to you.

Governing Law

These Terms are governed by the laws of New Jersey, USA, without regard to conflict of law principles.

Dispute Resolution Process

• Informal Resolution: Contact us first to resolve disputes
• Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration under American Arbitration Association (AAA) rules
• Class Action Waiver: You waive the right to participate in class actions

Exceptions

• Small claims court actions are permitted
• Injunctive relief may be sought in court

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any provision does not constitute a waiver.

Assignment

You may not assign these Terms. We may assign these Terms without notice.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our control.
